Welcome to AyL Legacy Hair. These Terms of Service govern your access to and use of our website, online store, products, services, and related features.

Throughout these Terms, the terms “we,” “us,” and “our” refer to AYL LEGACY LLC, doing business as AyL Legacy Hair (“AyL Legacy Hair”).

AyL Legacy Hair operates this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not access or use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority and have given consent for any minor dependents to use the Services on devices you own, purchase, or manage.

To use certain Services or purchase products, you may be asked to provide information including your name, email address, billing information, payment information, and shipping information.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the right to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to accurately display and describe the products offered through our store. However, colors and product appearance may vary depending on lighting, photography, screen settings, device type, and other factors outside our control.

HUMAN HAIR PRODUCT NOTICE

Our wigs and hair extensions are made with human hair. Because human hair is a natural product, slight variations may occur between individual units or bundles, including variations in color, texture, wave or curl pattern, length, and overall appearance.

These natural variations are characteristic of human-hair products and are not necessarily defects.

The appearance and texture of human hair can also change depending on washing, conditioning, brushing, combing, heat styling, humidity, products used, installation methods, and general care.

Product photographs may show hair that has been professionally styled, curled, straightened, brushed, washed, or otherwise prepared for photography. A product's appearance upon receipt therefore may not be identical to a styled photograph.

Customers are responsible for reviewing the complete product description, specifications, photographs, care information, and applicable store policies before purchasing.

Unless expressly stated otherwise in a product listing, photographs and videos are intended to provide a reasonable representation of the product but do not constitute a guarantee that every individual human-hair unit will be visually identical.

All product descriptions, specifications, prices, and availability are subject to change without notice.

We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction where permitted by law.

SECTION 3 – ORDERS

Submitting an order constitutes an offer to purchase products from AyL Legacy Hair.

We reserve the right to accept, decline, hold, or cancel an order where permitted by applicable law, including when we reasonably suspect fraud, unauthorized payment activity, pricing or inventory errors, or other problems affecting fulfillment.

An order is not considered accepted until payment has been successfully processed and the order has been accepted by us.

Please carefully review your order before submitting it, including product, texture, color, length, quantity, shipping address, and contact information.

Once processing or fulfillment has begun, we may be unable to accommodate changes or cancellation requests.

If we cancel or materially modify an order, we will attempt to contact you using the email address, phone number, billing information, or other contact information provided with the order.

All returns, exchanges, and refunds are governed by our Refund Policy.

Customers are responsible for providing complete and accurate shipping and contact information.

We reserve the right to limit or cancel quantities purchased per person, household, account, payment method, billing address, or shipping address where reasonably necessary to protect our business or customers.

SECTION 4 – PRICES, PAYMENTS AND BILLING

Prices, discounts, promotional offers, and availability are subject to change without notice.

The price charged will generally be the price displayed when the order is placed, subject to correction of obvious pricing or technical errors as permitted by applicable law.

Unless otherwise stated, listed prices do not include applicable taxes, shipping charges, customs charges, duties, or other charges that may apply.

You agree to provide accurate, current, and complete billing and payment information.

You represent that you are authorized to use the payment method provided and that the information submitted in connection with the payment is accurate.

We reserve the right to correct pricing, promotional, inventory, or other errors and, where permitted by law, cancel affected orders and issue any appropriate refund.

Discount codes and promotions may be subject to separate conditions, expiration dates, product exclusions, minimum purchase requirements, and other restrictions. Unless expressly permitted, promotions and discount codes cannot be combined.

SECTION 5 – SHIPPING AND DELIVERY

Shipping and delivery timeframes provided by AyL Legacy Hair are estimates unless expressly stated otherwise.

Processing time and carrier transit time are separate. Carrier delays, severe weather, holidays, customs processing, incorrect addresses, transportation disruptions, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for entering a complete and accurate shipping address before submitting an order.

Once an order has been transferred to the applicable shipping carrier, delivery is subject to that carrier's operations and procedures.

Tracking information, when available, will be provided using the contact information associated with the order.

Customers should promptly contact us if they believe an order has been lost, damaged, incorrectly delivered, or otherwise affected by a shipping problem so that we can review the circumstances and determine what assistance may be available.

Nothing in this section limits rights that cannot legally be excluded under applicable consumer protection law.

SECTION 6 – RETURNS, EXCHANGES AND REFUNDS

Returns, exchanges, cancellations, and refunds are governed by the AyL Legacy Hair Refund Policy.

Because wigs and hair extensions are personal-use products, certain products may be subject to eligibility requirements for return or exchange for hygiene, safety, and product-integrity reasons, to the extent permitted by applicable law.

Customers should review our Refund Policy before purchasing and before altering, installing, wearing, washing, coloring, cutting, bleaching, chemically treating, or otherwise modifying a product.

Nothing in these Terms or our Refund Policy limits any rights or remedies that cannot be waived or restricted under applicable law.

SECTION 7 – PRODUCT CARE AND ALTERATIONS

Human hair requires appropriate maintenance and care.

Product longevity and appearance may be affected by installation, washing, coloring, bleaching, chemical processing, heat styling, adhesives, styling products, maintenance practices, environmental conditions, and frequency of use.

Customers are responsible for following appropriate hair-care practices and any care instructions supplied with the product.

AyL Legacy Hair cannot guarantee a particular result after a product has been altered, chemically processed, colored, bleached, cut, installed, or otherwise modified by the customer or a third party.

Nothing in this section excludes responsibility for a product that was defective when supplied where applicable law provides the customer with a remedy.

SECTION 8 – INTELLECTUAL PROPERTY

The Services and their content, including trademarks, trade names, logos, branding, product names, text, graphics, photographs, videos, designs, website elements, and other content, are owned by or licensed to AyL Legacy Hair and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes.

Unless authorized by us or permitted by law, you may not reproduce, copy, distribute, modify, republish, sell, exploit, or create derivative works from our protected content.

The AyL Legacy Hair name, AYL Legacy branding, logos, product names, designs, slogans, photographs, and other brand identifiers may not be used without appropriate authorization.

Shopify's names, logos, products, services, designs, and slogans are trademarks or intellectual property of Shopify or its applicable licensors.

SECTION 9 – OPTIONAL TOOLS

We may provide access to tools, integrations, payment services, social platforms, applications, or other functionality supplied by third parties.

We may not control or monitor these third-party tools.

Use of third-party tools may be subject to separate terms and privacy policies established by the applicable provider.

To the extent permitted by applicable law, we are not responsible for third-party tools or services that are outside our reasonable control.

SECTION 10 – THIRD-PARTY LINKS

Our Services may contain links to websites, platforms, applications, or resources operated by third parties.

We are not responsible for the content, accuracy, availability, policies, products, or practices of independent third-party websites or services.

Customers should review the policies and terms of third parties before engaging in transactions with them.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

AyL Legacy Hair is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our store are made directly with AyL Legacy Hair.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and AyL Legacy Hair, including any injury, damage, or loss resulting from purchased products and services.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made directly with AyL Legacy Hair.

You grant us, to the extent permitted by law, a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, adapt, and distribute Feedback for purposes including operating, improving, and promoting AyL Legacy Hair and our products.

You may not submit content that violates another person's intellectual property, privacy, publicity, or other legal rights or that contains unlawful, abusive, defamatory, misleading, malicious, or harmful material.

You remain responsible for the accuracy and legality of content you submit.

Our Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, photographs, pricing, promotions, shipping charges, transit times, inventory, or availability.

We reserve the right to correct errors, inaccuracies, or omissions and update information where permitted by law.

Where an error materially affects an order that has already been submitted, we may contact the customer regarding the error and, where permitted by law, cancel the affected order and issue an appropriate refund.

You may not use the Services to:

• infringe intellectual property or privacy rights;
• submit fraudulent or intentionally misleading information;

We reserve the right to limit or block automated access where necessary to protect our Services, customers, or business.

WE DO NOT WARRANT THAT ACCESS TO THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, GUARANTEES, RIGHTS, OR REMEDIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 19 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AYL LEGACY LLC, AYl LEGACY HAIR, AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THE FOREGOING LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

SECTION 20 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless AyL Legacy Hair, AYL LEGACY LLC, Shopify, and their applicable affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable costs arising from your material violation of these Terms, applicable law, or the rights of another person.

SECTION 21 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

SECTION 22 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies incorporated by reference constitute the agreement governing your use of the Services, subject to any rights that cannot be waived under applicable law.

SECTION 23 – ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transaction, subject to applicable law.

SECTION 24 – GOVERNING LAW

These Terms of Service and any separate agreements through which we provide Services are governed by applicable federal law and the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.

Any dispute will be subject to the jurisdiction of courts having lawful jurisdiction over AYL LEGACY LLC and the dispute, except where applicable law provides the customer with another right or forum.
